Grand father & mother property rights.

my grand father and my mother acquired property on their own earnings. I am 55 years old and married with two grown up children with decent employement. iam away from both My grand father and mother for several years as my husband works in diferent places. from 1991 I am In touch with my Grand parents as well with my mother. a year ago my grand parents died and my grand father has written a will to go his property to my mother and after that her grand son(my brother's son. My brother also expired) During writing this "WILL" (Veelunama) nobody of my family informed me though I am in touch with them. since my childhood my grand parents named half portion of the property for me and rest for my brother (expired) as my parents were illegally separated and maintained their own life with their other partners(not married) as my grand father lived with his daughter or my mother (wife died)for few years as he was sick. (He used to stay with me also when he was able to travel by bus to my place 170 kms away.) During that time my mother and my brother's widow and her children (grown up) managed to get this veelunama on their favor without any share for me. I am planning to fight for my right share on my grand father property and mother own property too (she is worth may be one Rs.crore. All their earnings are given to my brother when he is alive and now to his widow wife(employed as teacher) and her children especially her son, who lives with his grand mother. Can any one suggest the right solution please?

If you suspect that the will is fabricated then, you can challange it in the court. You have no right in the property of your mother during her lifetime.

No other option except to challenge the WILL by a law suit in civil court.

Visit personally to a local civil law practitioner .

What is the ground with you upon which you have claimed that your grand father had given 50% share to you? Is there any document to that effect?

If no then you have no other option but to do as already advised and if the reply is yes then there can be some other grounds for you to move ahead. Engage the services of a local lawyer.

You cannot get any share out of the properties of your mother during her life time as the properties are her self acquired.
