How to approch magistrate if police refuse file complaint / fir

(Querist) 17 March 2013 This query is : Resolved 
my friend's attacked by 5 people. He wants to file complaint under ipc sec 143 , 147 , 148, 149 , 323, 328 ,504 , 506(2). Police refuse to file complaint



Now he plans to file a complaint to magistrate first class for the same.

1) Is there any fees for criminal complaint to magistrate?

2)does criminal complaint to magistrate first class require affidavit or self attested will work and any specific format for affidavit.


any website which has all format of crpc and court procedure. I am searching on google but I am not able to find such website providing format for all criminal proceeding.

1. The fee of lawyer and other litigation expenses in required in that situation.

2. Complaint should be supported with the affidavit with relevant documents like medical evidence (MLR) and copy of police complaint, if any.

As yo are a lawyer so get help of seniors of your bar instead of searching online as there may be many irrlevant items in the format, if any found online.

1. There is not much court fees required. However of you engage ana advocate his fees is to be paid.
2. For such petition u/s 156(3) crpc no affidavit is required.
