If my father dies without making any will , can I suit partition for my share in my paternal property -a dwelling house where my brother and his family lives?If they refused to give me my share what actions can be taken against them.
Do I have any right to live in my paternal house by seeking partition after my father's death? My mother has died 21 years ago.

In whose name the house is standing? If the house belongs to your father then after his death then you can file a suit for partition of the said house along with her immoveable properties if any and if your father dies intestate. The number of your siblings would have helped me to determine your share as well. Send details for further help.

Yes If your father die intestate you have right to get partitioned all the property movable or immovable.you have also right to live in your paternal house.
