Ipc 324, ipc 323

My cousin has been accused of IPC 323 and IPC 324. He got a job offer in Dubai.We are not sure of the trial date as police said it will take more than a year to start the trial. Can he leave for Dubai or he is not supposed to leave India? He badly needs that job. Is there any way to deal with the situation?

He can go only with permission of court .

Pendency of criminal trial is no restraint to make foreign travel and hence no permission of court is required.
Permission of court is required only when the court while passing order of bail imposes any restrictions on foreign travel.

Let him go to Dubai and be available for attending each and every date (may be once in three months and may be thrice in one month)

or

let him seek permission of court to go abroad

or

seek mercy of complainant and get the case withdrawn.

He is yet to receive the summon.

at whatever stage the case may be option given above are three he has to choose.


If any of the three options are not feasible then let him remain in Indian only.

There are no hassles at present ( so long as he has not received the summons) unless he is on bail.
