Legal heir - clarification on class 1 and class 2 members

Hi Sir,

Is it mandatory to include class-2(father) in legal heir certificate from thasildar when class -1 (wife, son and mother) are alive.

Also if father is included in the legal heir certificate what are the implications. Is he also eligible for an equal share
