(Querist) 16 December 2015 This query is : Resolved
Hi, I have a friend whom I know in my college, After the completion of my college one day he messaged me in facebook that he is need of money ( 6000/- ) , and he will give it with in 5 days, so I have transferred (Online Banking) money but he is not giving money till now almost 3 months over. When ever I call him he gives so many excuses. and I'm not getting what do I need to do to get my money back. I don't know where he lives. I have only two references of him one is face book and other is phone number. What can I do in this situation.

Money transferred online must have gone into his bank.U may file a complaint of cheating as otherwise ,the cost of recovery will far exceed your dues.

1. How can I file a case against him
2.what is the minimum duration of time to file a case.
3. I don't have proper evidence other than online transfer transaction and facebook message is that enough to file a case
Adv. Yogen Kakade (Expert) 16 December 2015
Hi,
You can file a recovery suit against him. the online transfer transaction record can be a good evidence.
But as you said he is your friend.. for such small amount whether you want to sue him..
Try and talk to him before you go for legal action.

Rs 6000/-?
civil suit?
on a person who you do not know?
without any loan agreement?

good joke.

Do you think any lawyer would file a case for fee and stationary charges less than 10,000/-?
Sudhir Kumar, Advocate (Expert) 16 December 2015
Money given to friends and relatives is always a charity in the garb of loan which is given in expectation of refund but always taken with intention of non-refund.

You case is peculiar you gave money to a stranger.

Just forget the money and sit home. Do not insult your charity by demanding back.
