Monkey menace in new flat

(Querist) 16 May 2013 This query is : Resolved
In our new flat premises there are lots of monkeys and are menacing us.
While booking the flats builder(through his marketing agents) had verbally assured that monkeys will be moved out before possession.
Now builder is avoiding those promises.
Also it is not easy to reallocate monkeys as forest department is not co-operative.

I wanted to know if unfortunately any untoward accident happens due to monkeys like monkeys damaging property or pushing kids from upper floor etc. which may lead to fatal attack/death then in that case can builder be held responsible in any way?

to be on safer side send legal notice to

builder to remove monkeys from flats

Thanks R.K Nanda and V R SHROFF for the replies.
It is in Bangalore area.
Forest department is reluctant and say monkeys are living in their natural habitat though many new buildings are coming up in the area.
Builder cite reasons like hindu villagers sentiments might be hurt as they consider monkeys as god.
Even I am a Hindu but all these execuses are not sufficient for shed their responsibility by builder.

MONKEYS are smarter than human. No compound Wall or fence can stop them. No lawsa are applicable . No stay order for them .

You can only enjoy natural jungle Life with them !!
Builder must be helpless too. No Legal remedy to my knowledge.
Govt. is unable to do so. You can only wire mess your balconies, doors windows, to obstruct them.

Lots of Monkeys in Matheran, All enjoy it.
Enjoy their company, soon you will learn how to safeguard yourself.

Sorry, but I have no legal remedy for your peculiar case, nor any citation to help you.

AFTER ALL, MONKEYS ARE OUR FOREFATHRS: THEIR ANCESTRAL PROPERTY: THEY HAVE RIGHT TO LIVE.

Thanks ajay and shroff for the reply.
Ajay I like your comment.
But monkeys are good in hill stations like Matheran.
But when they come to cities like Pune/Mumbai then it becomes a menace.

residents of your colony cna stage a rasta roko to draw attention of the civic authorities to the problem .
