Obc non creamy clarification required

I am a OBC and previously fell under the creamy layer category as i was with my father. I have applied for legal separation from father and the same is granted by a civil court. My individual income is <2 lakh per annum.
will the father's income (greater than 6 lakhs) still make me in creamy or non creamy layer?
Will my father's age and occupation matter after legal separation?

Part of the ancestral house is the property being mentioned above. No income from land. I am a student and sustain by giving tutions to school students.

@Venu Sir : the separation affidavit was filed in civil court and the same was processed as a Partition Suit and i was granted separation by the court order. the order included the property separation details where i got a part of the ancestral house.

Once you are legally separated through court from your family, then you shall be treated as individual person subject to you attains the age of majority.

As you are right now, a non-dependent person on your father you can show only your income to get the OBC status by filing the court order along with application to obtain the OBC CERTIFICATE.
