Property and poa

(Querist) 07 February 2013 This query is : Resolved
The house in which my parents are living was constructed by my father and myself. It is in my name.

Since I work away from my home state i had given a power of attorney to him in general terms.

Can he transfer or sell it or assign though a WILL to my sister or her daughter or convert it into a trust.

is your pwer of attorney regd? if so your father can sell the property . necessary to go through the power of attorney executed by you .
Advocate Bhartesh goyal (Expert) 07 February 2013
If you have delegated the power to sell your father through such power of attorney, then he can do so.

agree with experts.

if the house is in your name your father cannot execute any 'will' or create a trust on his own.In respect of transfer, he can do it only as your agent if you have given him power to do so through a registered power of attorney.
