What is meant by actual costs ?

Hi

We have applied for 498A & DV case transfer to our city from the girls place in the district court as suggested by my lawyer and it is pending before the court (actually girls side are influential persons and they are threating us to kill). Now, my lawyer says are u ready to pay the expenses like food , car travel and other expenses etc for police and girls side people for each adjournment nearly 4 to 5000 rupees. Is this true that we should pay such large amount. i came through one of the website that actual expenses can be made, what is actual expense mean here? . Please let me know, if there is any alternative, if we ask for some neutral place can we avoid these expenses.

U have to pay reasonable charges incurs to ur wife and there is no option of neutral place

Travelling with escort/ brother/ father , residence in hotel with food, are the actual expenses , and husband have to pay to wife, if she have to travel out of her district.

CAR or FC. 3 AC train & type of hotel , depends upon the earning of Husband and lifestyle adopted prior to sepn.

THERE IS NO NEUTRAL PLACE. COURT MUST HAVE TERRITORIAL JURISDICTION, to try your case.

u did not mention distance in KM to travel , so cannot ans 4k 5k

Thank you for your response. it is in the same district of 50 kms distance, moreover she is employed. Is there any limit cap on the expense or she can come by A/C cab and use 5 star hotels for dinning. i recently lost job and currently doing small job for 15000/-

It is subjective thing.If a constable has to attend the court his T.A. D.A. for which he is authorized as per his service rules.For Police Inspector the would differ and get increased.So for SP it would be even greater.

In your wife case:if she was dining along with you in 5 star hotel,then she can claim still now,if she was using a reserved taxi for a 50 km journey and never used bus,then taxi fare,otherwise bus fare plus autoriksha charges.

Is she have any such experience with you.

People can easily do to and fro for a 50 km distance.Then only journey expenditure is required.May be lunch too.Give the court proof of your earnings.That will be suggestive of her status.
