498a ab for me has dismissed in district court.

Hi,

My wife filled 498a on me and my family & my relatives on 30/06/2012. After we immediately applied for AB. Today district court has given AB for all my family member but not to me. What will be next procedure for me. Its been around 3 weeks,I'm abscond. How much time does it take, if we apply at High Court.

There are some conditions which has been directed while giving AB to my family.

- My family and my relative have to show 5 people for surity.

- Every Week , my family and relative have to sign @ police station , we cant travel for every week. I request some one to advice me, is there any chance of workaround for this.

Anticipatory bail can not be granted as a matter of right. Applicant can approach High Court for grant of anticipatory bail even if his application is rejected by the Court of Sessions, but not vice versa. Where a matter of dowry death is under investigation it is not prudent for High Court to grant anticipatory bail. If the application for anticipatory bail is rejected the second application is not barred.
