A layman's query on summons issued by civil court .

Dear members,

I am businessman by profession, and hence a layman when it comes to Court procedures . I had filed a Civil Case ( Title Suit ) in the Court of Civil Judge Sr Div . The case was filed on 04/03/2025 and the date of First Hearing is on 22/07/2025 .

My first question is, approximately how many days before the hearing date, the summons would be issued ?

Secondly, what steps would the Court take if the defendants do not bother to appear on the hearing date ?

I ask this because, unfortunately the defendants are a bunch of arrogant folks, who are of the opinion that they are above the Law . So there is a very good chance that they would just ignore the Summon and not appear on the hearing date .

Thanks and regards .

1.there is no fixed time limit to send summons to defendant by court but it should be done at the earliest.

2. If defendants after the service of summons on them do not appear in court on date fixed court will proceed case in their absence.

Generally the summons will be sent from court at least one month before the date of hearing or at least one week if there's no time in between.

If the defendant is not appearing then the plaintiff will be advised to initiate further steps as per law.
