Adding surname is voluntary and not mandatory as per my knowledge. Immediately after the birth, as surname of father is desired, they will add surname. (Immediately after birth there may not be a necessity to register the name. Hospital can only inform the name of mother and father , about gender of the child. , later after naming ceremony parents may add the name given to baby for obtaining birth certificate.
Since generations the mentioning of surname, and addition of husband's name is being done as a practice. There are many instances where married ladies retained their father's surname. It depends on the married girl whether she wishes to retain or acquire her father's or husband's surname. In some communities there is no surname practice.

Yes, in our country, there is no law as to names. There could be customs and usages; but they do not have the force of law. So any one has complete autonomy to choose hi/her name, as well that of their wards.
