The employer /establishment can draft and frame private rules/policies that provide similar or superior benefits to employees as compared to applicable enactments.The provisions of the applicable enactments shall prevail upon any private rule/policy/agreement drafted by employer and signed with employee e.g; offer letter, appointment letter, HR policy, service rules etc ..
The private rules/policies that provide inferior benefits may get termed as void and fail test of law.
