Age of ink -determination. new round started.

After several twists, the question, whether age of the ink in an instrument can be traced, is almost settled for a while, with an answer that it could be traced. But, now the latest judgment (dt.18.7.2012)of the Madurai bench of the Madras High Court, held that no such fecility  is available in India at present to find out the age of the ink. The ball started rolling again. A very good citation regarding age of any instrument.

1) However I am of the opinion that this objective could have been achieved by proper planning of the defense from day one.

2) As their lordships have opied that it is a tactic to delay the case. Such presumptions are drawn because of last minute decisons in the defense.

 

It is the general practice the cheques are taken in advance , may be signed by the accused but all other particulars are filled up later by the complainant. In the above case the accused advocate must have brought all these circumstances on record by clever cross examination.

 

Even the belated application for forensic examination should have been for all other writtings on the complaint cheque  and not alone of the signatures.
