Am i eligible for annulemnt

Hi All,

I am a Hindu & got married in Feb 2014. The marriage is not consummated at all due to her refusal. She says that she doesn't like me & is not interested in any s*xual acts (even normal touches) and also not interested in married life itself. She says that she agreed to the marriage only because of her family pressure.

She says that she is ready to give divorce, but asks me to take action. We aren't living together as well...

I want my marriage annulled. Is my case eligible for the annulment of marriage by any other means?

Hi Dana Kayoni, Thanks for your reply... I need some more clarification regarding this issue...

 

Some lawyers are telling that my case is not eligible for annulment because

 

1. my marriage was conducted as per the Hindu customs... They say 'Under Hindu Marriage Act, there is no provision of Annulment'. I couldn't understand the nuance of Hindu Marriage Act law... 

 

2. Annulment case should be filed within 1 year.... 

 

Is it right? Or I can go for Annulment... I prefer Annulment by any means...

1) Its not a voidable marriage.  No annulment as ur lawyers say after one year.

 

2) U hv to opt for divorce, which when u go she may rescind her version.
