Husband and wife stay in USA
Husband is green card SHE entered USA on Student visa showing she was unmarried in 2009
The husband has filed divorce, wife countered and filed for divorce. in 2013
Again wife filed for annulement saying husband had married in US before coming to INdia to marry her. Which she had said she was fine. maybe before she came to USA. All she wanted at that time was to come to USA.
But wife and husband married in USA to husband. in 2011 and court is seeking that marriage in USA and divorce for that marriage. which was legal as husband was not married to anyone at that time.
Now wife wants annulement of that marriage and wants to go to india permanently [which is faking] with 3 year old son. and file cases in india against husband.
So now question is. Which marriage will be annuled.
the marriage she say was in india as her husband was married in usa during that time.
OR the marriage in 2011 in usa.
Also what is the time frame to petition for the Bigamy
how to proceed.
