Appeal - need guidance.

I had filed petition u/s 11 of HMP. 

wife & her first husband were co-respondents.


My application was allowed - Hon. CJSD court declared my marriage void ab initio.


respondent wife has filed appeal in District court.


1) kindly let me know setp by step procedure of appeal.


2) pl. let me know DOs & DONTs.


3) apart from 21B, what other measures do I have to expedite the Appeal case ?


4) is it allowed to file interium maintenance application (u/s 24 HMA) in this case ?

in her cross during trial, wife deposed that I (I = author of this post) DO NOT earn anything

she is govt. servant - salary 35 K per month.

No arguments.  Just based on documents given to the court, court will allow or disallow the appeal.


24 HMA, and she is a govt employee, if you have provided details of her employment, then what's the need for you to worry.  On the other hand you can claim maintenance from her.

yeah !

during trial, i have given evidences of her govt. service + salary.


i m planning to file sec. 24 and ask for int maint from her

 

 

further query :

to save time, i m planning to be present on the very first date (without waiting for the summons / notice) in court. ANY DISADVANTAGES ??

 

i have also filed caveat application already before her filing the appeal.

:)LOL HMA 24 she is pulling the carpet from under her legs by stating that you dont anything . A very good opportunity to claim maintanence under sec 24 of HMA

in fact i m not willing to file sec. 24, because, this is not the relief i need.

harassing the opponant is not my intention

i want just relief without unnecessary delay

File section 24 ASAP.  Neki aur pooch pooch?

no sainthood !

i dont want a single penny from that Lady.

also filing such application will delay the disposal of appeal.


my expected relief = Confirmation of decree of nullity of marriage & NOT maintenance.

1) kindly let me know step by step procedure of appeal.

 

1. appellant filed appeal + application for interium stay on the decree of lower court.

2. the case got register number.

3. then the case got Regular Civil Appeal number.

4. now the file will be sent to concerned Hon. District Judge.

 

what next ??
