Applicability of bns act

This query is by a senior citizen being harassed by police.

Please advice under which section of BNS  police is required to register a complaint of fraud & cheating and investigate it before registering the FIR?

He was not heard by Mumbai Police and it verbally refused to act in the matter as opposite party is very resourceful. Please help. Thanks

  • Section 179 of BNSS, 2023

    This section gives police officers the power to investigate cognizable offenses without a magistrate's order. 
You may file a petition under section 179 of BNSS, 2023 before the jurisdicitonal judicial magistrate court. A magistrate can order an investigation if the police refuse to register a First Information Report (FIR).

Why did the complainant / you not invoke the provisions of Maintenance and Welfare of Parents and Senior Citizens at, 2007, when the complainant is stated to be a senior citizen ?
