Is possesion of Gun Lighter depicting 9mm Beretta Pistol legal or illegal in india ?

Imitation firearms are not covered by Arms Act 1959, read Section 45(c) of Arms Act 1959. Also imitation firearms are neither arms or firearms as defined under Section 2 of Arms Act 1959.

Also I see that you have raised a query regarding knives at https://www.lawyersclubindia.com/experts/Possesion-of-knives--303801.asp Answer to your query lies in Section 4 of Arms Act 1959 and Rule 19 of Arms Rules 1962. Therefore do an RTI with the Home Department of your State to get copies of Notifications issued under Section 4 of Arms Act 1959 that are in force in your State. When a lady holding a licence for gun then after her natural death the gun is found from her home then is her husband liable and punishable under the arms act as he is holding that gun without legal licence in his own name.

There is nothing to panic for the husband but should avoid unreasonable delay. He may deposit the gun with an arms dealer or police station. And at the same time apply for an arms license in his name or any other family member under family heirloom. The applicant will be required to submit no objection certificate from all legal heirs to the gun. Once gets the license in his name, he can get the same gun endorsed on his arms license from the licensing authority.

Husband can use Rule 46 of Arms Rules 1962 related to Section 21 of Arms Act 1959 to deposit the gun till any of the legal heir of the gun is able to obtain license under family heirloom category.
