Arrest procedure of proclaimed offender

I filed a complaint U/s 156(3) to the Magistrate in Delhi and an FIR was registered U/s 420,406,120-B,34 IPC against some persons in West Bengal. The FIR was registered in Feb 2013 and after our sustained efforts Process U/s 82 was executed by police and subsequently the Persons were declared Proclaimed Offenders by the Ld. Magistrate in April 2014.

Since Delhi Police was not interested much in arresting the accused, we had approached senior officials in personal capacity in West Bengal Police and submitted the PO Order and an copy of the FIR and requested them in arresting the accused so that in the meanwhile we would press upon delhi police to seek their remand/custody.

Now officials in West Bengal Police are stating that they require some kind of letter from the Police Station where the FIR was registered before they can proceed. Is it factually correct?? As per my understanding it is the duty of local police to arrest an PO if he is found residing in their jurisdiction. And as per CrPC any citizen can arrest a PO. Kindly give advice as to how should i proceed.


Also, how can i go about getting an publication order from the court of magistrate so that i can get pics of the accused in local paper declaring that they are PO's.

Any help will be greatly appreciated.

It is better follow it up with Delhi police to get the arrest warrant executed through West bengal police. For getting publication order u have to file petition under 82(2) crpc and get it pasted in the place or town where normally accused resides, then u can expect public assistance in this regard.

It is correctly understood by you that there is no requirement of any kind of letter from the Delhi police . the order under s 82 is enough to arrest the offender's now it is the responsibility of the Delhi pl to abide by the order once they are informed
