Dear All,
After having lost the transfer petition in SC she now has started to argue on the case all over again. The SC in its order had cited that the mediation consent terms had been arrived at between the parties and hence they were dismissing the case.
Now back in trial court which is looking at the matter on the settlement terms she has started to point issues when she had signed them, I had abided by them and she doing so partially, is now resiling.
What are my options?
1. Should I file a petition under Article 142 (as she also has a maintenance case in another state), so that the trial court matter in one state which was almost closed based on settlement terms and the maintenance case in another state) in SC asking for closure of both cases, as we have been fighting for 4.5 yrs in court and 65 and 27 hearings respectively have happenned in each state and there is no end in sight?
Please advise.
