Authorization by company

Hi Friends...

I don't remember but i read somewhere in some citation that "the person who is not employee or director of company (only stranger) , can not be authorized person to file a cheque bounce case"

if someone has seen this in some judgement, pl share with me...

Thanks...

This is tricky.

Anyone can be authorized to be the complainant on behalf of company, under proper authority.

But the point is his examination under S.200 ?? A person who is not the employee of the company is  a stranger to the transactions, he cannot be examined.

So one of the right position is :

A non employee under proper authority along with a witness employee for examination about transactions under S.200.

This non employee can give evidence only about his authority, while this witness employee about the transactions.
