Bonus not paid

I have worked for a company for seven months. The company have given me offer letter only in which salary break was mentioned. The total negotiated salary is divided by 13 months out of which 12 monthly salary & one month salary was declared as bonus. It is mentioned that bonus will be performance based. I resigned the company after 6 month 7 days & served the one month notice period that was not mentioned in the offer letter. When I asked for the bonus amount for my worked period company informed me that the bonus will be paid to you if you worked till september(app. 3 mire month). How can I get my bonus amount as it is more than 50k. Satish

Your employer has rightly advised you.

As the Bonus is performance linked and the caluculation is also very specifically 12 month + Bonus amount equivallent to 1 month salary ie., In case your performance is meeting the required standards then you are eligible for the performance bonus.

As per your communication you have not completed the performance cycle of 1 yr hence the appraisal is not completed / your performance is not evaluated hence the bonus part doesn't come in to picture.

That is the habit of Kumar Doab only. The employee may request Mr. Doab to take credit by geting bonus paid on prorata basis.

Submitting a request to employer, of course under proper acknowledgment is neither misconduct, nor altercation nor litigation...........

Instead of remaining quiet, submit a request.

Remain amiable and gentle.

Who said submitting application to employer is misconduct? But making any futile exercise to offend an employer without the provisions in law of course is nothing except miguiding the querist. It would have been appreciable, had Mr. Kumar Doab advised the querist by quoting some legal provision in support of his advice, rather than intentionally misguiding him, as against the legal provisions.

Although I am a jigyasy (learner), but fully understand, who advises correctly and who makes posts merely for his pass time & fun, without caring for legal provisions.

Negotiating annual/monthly pay package is a right and skill that employee can acquire and nurture.

Take help of elders of the family, competent and experienced well wishers, seasoned Employee's/trade union leaders, a very able LOCAL counsel of unshakable repute and integrity specializng in Labor/service matters to become properly infomed...........
