Any company cannot be expected to fulfill the wishes of the employee, elders of his family, even if approached through trade union leaders. Only law compels them to pay through their noses.

Who said submitting application to employer is misconduct? But making any futile exercise to offend an employer without the provisions in law of course is nothing except miguiding the querist. It would have been appreciable, had Mr. Kumar Doab advised the querist by quoting some legal provision in support of his advice, rather than intentionally misguiding him, as against the legal provisions.

Although I am a jigyasy (learner), but fully understand, who advises correctly and who makes posts merely for his pass time & fun, without caring for legal provisions.

 

 

80years + of age and instaed of Allah, Allah, Bhajan........................daily litterance of abuse, nuisance, and sarcasm..............

It seems Kumar Doab don't have even commonsense that statutory bonus is not paid if does not become legally due to the employee.

In the wake of two vague & contradictory statements of Mr. Kumar Doab, i.e., "The matter is statutory bonus per Act," he himself has the dire need to use his common sense, whether statutory bonus and the performance bonus, as claimed by querist, are the one and the same thing. HAD HE SOME COMMONSENSE OR READ THE PAYMENT OF BONUS ACT, HE WOULD HAVE BEEN ABLE TO EASILY DIFFERENTIATE BETWEEN THE TERMS OF "STATUTORY BONUS: UNDER THE PAYMENT OF BONUS ACT AND THE "PERFORMANCE BONUS." when the querist has very clearly stated, "It is mentioned that bonus will be performance based." If Mr. Kumar Doab did not have any legal sense, he was expected to use at least commonsense before making vague & misleading posts.

The querist may better take Mr. Kunmar Doab along with him to his employer, if he feels capable to get him the amount of bonus under the provisions of statutory Act on Bonus. In the absence of any legal expertise, he can't do anything, except making vague, evasive and misleading statements.

Well said. Mr. PS Dhingra has rightly pointed out. Senseless postings of Mr. Kumar Doab can only misguide the querists.
