Bribery

As we all know, if we have to get our work done from any government authority conveniently & expedietely , we need to bribe them. Well here I dont intend to debate or raise this issue as matter of concern, as we all have accepted this principle for granted. But now I have a serious problem since I have been asked to bribe & make some payment under the table to a government authority. But what if I am caught red handed in future since I dont intend to do such an act, however I am forced & pressurised by my employer. So will the blame be passed on to the employer or  will I have to bear the brunt of this  act. Kindly advice & if possible provide some case laws where an employee has been exempted for the act of the employer or what precautions can be taken to avoid any such hassles as this job is equally important to me?

how many times have u not payed the cop for catching you without helmet or for not fastening seat belt? Havent u bought a ticket in black? How about paying a lil extra for child`s admission?..we all contribute towards what the system is today.......

Corrup judge,Corrupt Government,Corrupt lawyer?

Firstly nobody is cribbing here. I think you have miscontrued my statement. Meenakshi, I am not here to debate on our governance, my concern is how can I protect myself in the hands of my employer who are forcing me to bribe the officers.I dont  want to set another example of  satyam .  I am already a part of this system, bribing a traffic police is a different phenomena as compared to officers where I have been asked to pay lakhs of rupees. I hope you get the point.

And please give me some valid reasoning to safeguard  my interest or do you want me to take some undertaking from them so that in future such risk is automatically passed on to the higher authority without me being involved.

Leave the job.Don't seek advice on how to commit a crime so openly on the net or even otherwise. Put ur foot down and say NO at the right time. Next time u may be asked to compromise something besides ur integrity. This is a test to see how far you will go in committing a crime in furtherance to a conspiracy. Any one advising otherwise would be committing a grave mistake.

A famous construction company had taken project in a state. Naxals were demanding extortion/levy from that company. Company didn't responded. Naxals set their equipments on fire and threatened their employees. Company complained to Police but it didn't help. Work got stopped. At last company negotiated with naxals and agreed to pay 40lakh as first installment. Manager of the company was assigned to deliver the sum to the naxals. Somehow police managed to know this. When manager was going with the sum,  on the way police intercepted his car and recovered the money and charged/booked him and poor manager was sent to jail. Company is fighting case on behalf of the manager.

It all depends whether a person is able to manipulate the things or not, which requires extraordinary cleverness. Every where it is the same story, employees were forced to do such things.

Anyway u should asked suggestions anonymously.

Thanks to everyone for your contribution. Luckily I am not the one going through this trauma, this is happening with  one of my known acquaintance. Actually I was more interested to get some  in depth knowledge about ' vicarious liability' between employer & employee. However the discusssion has gone into different lane.

You cheated us. if u wanted indepth knowledge about vicarious liability u would have asked so in the first place. You are still lying. Wish you a trouble free future. Nobody believes a liar.

Thank you for your concern Sir. In this world there are two types of writer, one who writes as a third party and the other one writes as if the event has been occuring in his life. If you notice my first question , I had clearly mentioned about the case law. Sir, If I had to lie, I would not have used my i.d, i could have been anonymous and got information. Whereas the vicarious liability is concerned, even I was not aware of this, since I am not a lawyer, it was conveyed to me by our fellow member through private messages.

Anyways thank you

Its OK.  Actually it is easy and more practical to be straight forward. Time tested old sayings still hold true. Regards.
