Builder not giving refund

My father had invested in a flat in pre-launch scheme in Uttrakhand in 2006 and paid 2 installments, We only have receipts from builder but no written agreement. However the builder has not made any progress in the project.

I tried to follow up with him but got no response till 2008 after which I gave up hopes. I only had verbal communication after that and no written proof. How can I get my refund. Someone suggested that one cannot file a case after 3 years of dispute. Please advise how to get my money back.

I think your case is hopelessly barred by limitation, however, just issue a legal notice through your lawyer demanding the said amount based on the receipts he had given, if he commits to it, the the limitation will be automatically renewed and then you can legally claim through a money recovery suit.
