Buyer saying he will not pay me final amt without prop. doc

Buyers wants property document without paying last final amt . he cleared my mortgage property. he will give us the banker cheque at the time of registration once he receive the remaining loan amount from his bank. can we give the documents.

In Term and condition we mentioned that if the full amount is not paid within one month of agreeement. Then the agreement is canceled. Almost four months till today, We have financial problems waiting for the money what to do?


Can we cancel the agreement in case if he takes his own time, because i have financial problems

The buyer has cleared your mortgage , so u are commited to the buyer ,to sell to him only. The expiry date mentioned in the document may not be much use. the buyer is interested in buying the property tell him your difficulties he will oblige Normally the property documents are released to the buyer only at the time of registering the property , having received the full sale consideration

Property doc are released and it is with us. Now the Buyer insisting for registration  and oncle it reflects in EC then he will get the remaining balance cheque from his HDFC Bank(Loan). He is saying without registration he can't get the cheque form HDFC and also saying he can't  move a inch without registration he is taking undue advantage because of  my fianancial situation.
