Buying property without original chain agreement

Hi,

 

The Original chain agreement is missing / lost along with the share certificate. All the original chain agreements where not registered as they happen to be very old since; earlier then 1990.

 

The seller has issued public notice pertaining to missing of agreements, share certificate etc. Seller also wishes to provide the Indemnity Bond, Society NOC and Society also shows willinness to issue duplicate cerificate.

 

Please advice which all formalities need to be completed before buying such property.

Documents not registered means the Stamp Duty is not paid... so the liability of Stamp Duty wil fall on you twice... the seller will have to pay stamp duty on purchase (before 1990) and you too will pay the stamp duty at prevailing rate. (2013).

The stamp duty office may not register the documents in the absence of agreement.
