Can electricity & water supply be disconnected in a cghs

 

Dear Friends,

I am a President of a Co-operative Group Housing Society (CGHS) in Delhi. The working of CGHS in Delhi is governed by Delhi Co-operative Society (DCS) Act, 2003 and DCS Rules 2007.

We have a Single Point Delivery Connection of Electricity and Water from the Electricity & water Utility in our Society and thereafter Society is responsible for the Distribution of Electricity & Water to each resident/ member flat. Here Society raise a bill of these services through individual water & electricity meter and is also responsible for recovery of dues through monthly maintenance bill.

My Problem,

We have few residents in our Society who have not paid the monthly maintenance bills for last few years and the outstanding amount is now more than 1 Lacs in some cases. Currently Society Committee is making the payment of Electricity & water for these above Flats to the respectively utilities through the Society Funds.

My Query,

Can we disconnect supply of Electricity & Water to these Flats? Please guide us mentioning the relevant Section of the Law in either of the case. In Case there is any verdict in any case from any court of law regarding the similar case, please let me know.

You must be having bye-laws for your Society. Do bye-laws deal with this issue, particularly that of electricity? Water connection is generally common. But most societies have individual meter for each flat. Is there any problem in getting separate connection for each flat?
