If you want precise guidance, come out with basic facts like 1.Who is the owner of the property? 2. How it was acquired 3.What are the ages 4.Present source of living 5.Present rights etc. Litigation is a complicated subject and differs from case to case depending on facts. ( For example, if stepmother is living in her paternal house herself, she may not like to support the stepdaughter as it may burden her parents etc.,)
Apart from the relationship, the issue here is more humanitarian and generally, no one disowns a relative (though a stepdaughter) unless the relations are terribly strained. Anyone may be having such legal rights, but to get the same legally through court it takes decades and after a wide gap in between several families. In case of such really demanding circumstances, there are still good relatives in the community left to stand and convince stepmother. To me it appears that even calling a stepmother, stepdaughter is itself most irritating, and honestly, stepmothers were not given proper either in Eastern or western literature. from Snow white/ Cinderella to Kaikeyi, Devayani./ It was impressed from childhood that stepmother must be a villain and there is extra sympathy factor for mother less child and complaints against step mother and advises to step daughter by society.

Your statement is bit confusing and vague as you did not clarify the point of ownership of the property.
