the question as it is ,is not complete as such in India this is a controversial topic as it is and it will be a matter of religion for a person to is seeking the guardianship as such if some one is hindu by religion if you have already adopted your step child then courts will be bound to treat you a guardian already rather than an natural guardian as such natural rights are authoritative in it's own but facts like what is your income the age of child you wish to adopt and how it would be better for the child if the child is ordered to stay with you and as such the gender of child will also be prevalent in such matters and at the basic the child may also be given an opportunity to be heard in court as to where the child wishes to stay and it is therefore said that all cases are separate and it will matter to your particular case but by general view it is possible specially if the natural guardian is abusive towards child or there is no one else with better opportunity in family of child other than you so the basic is interest of child as the court may decide after scrutiny of facts brought and argued and proved
