Caveat petition

Who has a right to file a caveat petition in context to civil law the winner in the trial or the looser?

Normally, the winner files such Caveats so that he gets a chance to state whatever that he wants to state before the Appellate Court, before the Court does anything detrimental to his itnerests - like granting stay of the order etc.

The loser will any way approach the Court by way of Appeal.  Therefore the question of the Loser filing the Caveat application is meaning less and simply does not arise.

the party who apprehend that other party may file appeal in higher court. file caveat in court so that notice of appeal be sent to him and appeal be heard in his presence
