Cctv footage

Hello, my wife filed false police complaint (NC) agaist me saying that I threatened her on phone and the she said I pdi personally also. I didn't threatened on phone nor personally. I do have backup of call recording, however regarding personally, I asked society committee, to give me backup of cctv footage, but society doesn't provide me. I never went to society from past 22days so questions of threatened doesn't arise. Wife filed false dv case against me. I have sent couple of reminders to society for footage but society doesn't provide me same.

CCTv footage information will be given to investigation office  in  police enquiry only not to general public. Once CCTV has been requested from the police, the operator must abide by the Data Protection Act to ensure that this footage is safe and secure and not handed to anyone other.

As explained by the expert Mr. Rama, the DPA (Data Protection Act) limits the issuance of CCTV footages to general public in order to prevent any sort of malicious intention of the person. However, the same can be attained by the IO (Investigating Officer) whenever he/she fills it fit and requisite for the purpose of investigation.

If the complaint is falsely registered then there's no point of you to worry, as the not only the CCTV but also the entry log book of the society would show that you haven't entered the society premises for almost one month (as you said in your post that you've not visited the society from 22days).
Thus, there's no way you'll be upheld as all the evidence proofs your innocence and the police will come to know about the false complaint made by your wife as soon as the investigation begins.

In case of any sort of ill-treatment from the opposite party or police officials reluctant behaviour towards the matter, you should appoint a local prudent lawyer in order to defend you in a court of law.

Hope It Helps
