The query lacks clarity, as which certificate has to be filed is not clear.  If a bank wants to file a case, the person who has signed the plaint/petition and acts on behalf of the Bank, and that person should have a Power of Attorney to sign on behalf of the bank.  The POA copy and original POA have to be filed, and the original POA will be returned after verification.

I am confused between two Act

1. application U/S 19 of Recovery of debt due to Bank and financial institutions Act 1993

or

2. application U/S 10 of Bihar and orissa (Public demand and recovery) Act.
