A Civil Application for Delay Condonation (in filing Review Petition) was allowed by a single Bench of the Bombay High Court. The main Apppl. being the Review Petition itself is not maintainable in law per law laid down by the Hon'ble Supreme Court (in the circumstances of the case at hand).
Will the challenge to the order of the Single Bench of the High Court lie to the Division Bench of the High Court? If yes will it be in a Writ or Letters Patent Appeal. Or will the Challenge lie before the Hon'ble Supreme Court in a SLP.
Is a writ against an order of a single bench to a Division Bench maintainable?
