Change in dir form

While filing the DIR form in the DV case, the section 7 on whether police assistance is required for filing an FIR was marked as "no". Now the case is going on in the court for the last three years . Can that request be changed to a "yes" since all sorts of harrsament illegal confinement etc have continued unabated now at the hands of servants of the opposite party also?

DIR is other name given to FIR in Bharat Ratna DV The Act, 2005, it cannot be changed once it becomes part of the material records of the ld. Court and any additional charges / appeals / modifications can only be added by way of allowing an urgency Application accordingly.

Here all that you have to do is to press your lawyer to get for you Interim protection orders citing from last 3 years the case is in trial stage and no interim protection order granted to me OR tonight fire your lawyer and tell exactly above underline bluntly to the concerned Court on next available date of hearing and if former is not possible to do by your means then atleast tell your current Lawyer to file an Application for change of Court showing biasness (i.e. no interim orders from last 3 years whereas The Act and @ Lord says in 60 days interim Order are passed!). If this is also not possible to do by your current Lawyer then ask him one more time to move your case to Sessions Court under appeal to seek “direction” to trial Court to dispose all interim protection orders in 15 days under reporting to Sessions Court citing your necessities and current complaints as in your last 3 lines of brief.

Calmly re-read such large para advise and take printout and paste it on your Lawyers Desk, if s/he still cannot do then contact @ Lord.

BTW, you are not alone here, many complainants have similarly told us that it takes years to get Interim Protection Orders but then who can go against @ Lord !

But to get the protection order ,the allegations have to be proved ...........has it been proved  !!  But 3 years no progress in matter suprising are you attending the court or has your lawyer taken full charge of your case in your absence !!
