Cheque bounce case

Page no : 2

Ranjit Kumar (Tehnology Specialist)     29 April 2012

Thanks for your reply!!!!!!

I have contacted accused superiors and shown the Non bailable warrants that are issued him. However, he did not show any interest on this part.

Now total 2 Non Bailable warrants are completed. What should I do now. Accused is not at all attending the court.

In July month, I am about to travel USA for 1 year. So, I am totally in confusion like what should I do now. My next hearing is on May 7th. Will the jusge again issue another NBW else will he take any action on Accused/ Police.

Accused office is hardly 100 mts from Police station. But also police is not arresting him.

Please guide me like what should be my next step in order to make him attend the court.

I hope that police has received the NBW through proper channel. If it is so, write a letter addressing to SHO of that station, just detailing about the NBW and give full address of accused both office and residence. Send a copy of this letter to area SP. Clearly mentioning that the next date of compliance is 7th may. You need not write goody goody language, write hard facts and take a stand. Try to take acknowledgment of this letter, and send to SP by registered post.

Give a copy of this letter to the deaprtment head (his government office ministry) and if on 7th police does not present this man or he does not surrender on his own, bring to the notice of the court, police inaction, thats all.

1) Getting NBW  issued without proper reason is also cr offense. SC has now issued stringant guidelines for the same.

2) Your loan is money landing in the grab of freindly loan and it will attract recently passed very strict LAW BY AP Govt.

Accused in NI 138 and their advocates please take care that where ever friendly loan is alleged in cheque bounce cases , YOU MUST TAKE THE PLEA OF ILLEGAL MONEY LENDING.

Most of the states have laws in place which prohibit money lending without permission by Govt.
