Respected Sir Arghyaji,

I appreciate your views very much. What action can be taken against the complainant, where complaint is false and only to harass. Another question is where it is is written in service rule even in govt or semi govt employees that they will be terminated if a summon or warrant is issued against them.

1) Mr Madhu Mittal at least you are delligntly trying to give answers to  otherwise legal querries.

 

2) However if no reply is recieved or un favourable reply people start abusing in street language but have any body sincerly thanked you.

 

3) Regarding agony of the advocate ARGHAYA , there are lot of options to book the complainants for false complaints but no body dares it.

 

Why because the law is simple it is your cheque, you have signed it and it is bounced from your account so law presumes basic guilt. That is also the reason the accused has guilty complex and takes lousy defense and gets trapped.

 

4) Again how many  advocates who actually conducts the cases in court  and give advice here and that is why their advice is never practical.

 

5) Very recently on this site one enterprising advocate gave advice to the accused that agree in the court for making payment. against bounced cheque .He also gave his many IDs abd cell nos and what not. SIMILAR ADVICE MANY OTHERS ARE GOIVING IN ROUTINE.

 

What happend since the accused admitted issue of cheque  its bounce  and agreed for payment ,SO COMPLAINANT need not prove any thing and so  the complainant refused to accept the cheque and lower court convicted the accused with jail term.

 

6) Coming to action on complainant on false cases, Crimonal complaint starting from  extorsion , and many other IPC sections can be made and make the advocate also a party and see the music.
