One of my known person stolen my chq. he summitted it in bank but i have reqesed bank to stop my chq which is in serial and recived it and also repoert in police station and and recived the compliant but he sumitted the case agaisnt me u/s 138
after some i have filed case against him and judge order him u/s 379 is this in favouor me

Yes. Sec. 379 is punishment for Theft. It means he is held guilty of theft.

You have to prove it by evidence otherwise it will be treated as counter to cheque case against you.
