Clarification on el encashment

Dear All

I am working with an Elevator company in Chennai which is registered with Tamilnadu Shop & Establishment act. Now our company has mentioned 12 days of EL per annum in appointment letter. It seems the company allowded encashment of leaves till last year. Now they have suddenly stopped it.

I am working here for past 2.5 Years and my actual EL balance should be 30 Days. But 6 EL has elapsed and i currently have only 24 days, which i think is the maximum one cap keep.

Now, my query is 

1) when i resign will company provide my encashment only for 24 days or for 30 days(from joining date irrespective of epalsed leave).

2) Will they provide it on basic or on gross. They have been providing on the basic. is this correct?

3) can i adjust this leave towards my notice period if i dont want to encash it.

You should have asked these questions to your company. Ecause every company has different set of rules.

'Tamilnadu Shop & Establishment Act'  was enacted to govern the service conditions of employees working in the establishments coverd by the Act.

 

 

The company covered by 'Tamilnadu Shop & Establishment Act' can not provide for inferior benefits to person covered by the def. of 'Employee' in the Act..............................It can certainly provide superior benefits.
