Club paid leave with notice period

Dear Sir,

I have 23 days Paid leave left unused in my Leave Card, and my notice period is 30 days .

Now, I have to join another company in 15days, so I will be physically working in present company for 15 days only, and can another 15 days be clubbed with my accumulated paid leave.? 

Can we compensate the notice period of 30 days this way.

Guide me in this regard.

It seems notice period is 1 month and you wish to be relieved at notice of 15 days.

Kindly check your appointment letter/service agreement/employee rules/standing orders applicable in your case, and confirm if you have given your concurrence on modalities of notice pay recovery.

You may submit notice of resignation with effective date of resignation clearly written in it , addressed to good offices of your appointing authority, MD, and request the good offices to inform you in writing to whom you should handover the charge, and submit the company property under acknowledgment. You may mention that you are willing to cooperate to train the employee whosoever is designated as your replacement employee, up to and within effective date of resignation, and ask to supply you the acknowledgment of notice of resignation immediately, and acceptance of resignation, FNF statement, payment of dues, work experience/service certificate, relieving certificate, form 16, PF accumulation reports and withdrawal/transfer forms, NDC etc by effective date of resignation.

You may submit details of payables by you to company e.g. advance/imprest cash if any, and payables by company to you e.g. incentives/bonus/leave encashment/salary/expense reimbursement etc and request the good offices to adjust the notice pay for......days @ basic/gross/CTC as agreed by you, in FNF statement. You may request the good offices to verify the statement submitted by you and let you know for variances if any, so that the needful can be done.

All accounts can be compiled in FNF statement.

In general the accumulated leave is not going to be adjusted against the left over days of notice period. If in your appointment letter, service conditons is mentioned that you can pay in lieu of notice period then the management will encash the leave amount  as per the company rules and adjust against the amount payable.

Some of the companies are very particular and they won't allow employee to avail leave in the notice period time and they will look for 30 actual working days but in general companies will have the option of either or .

Pl. discuss with your HR and finalize.

Learned Mr. Kameswarao has given valuable advice. Kindly follow it.

You can address query to your appointing authority, HR-Head and request to reply in writing and supply the rules/policy of the company in this regard, to substantiate the justification by the employer. You are within your rights to get the copy of the rule/policy, from concerned designated personnel of HR/admin etc, if it is not available at HR page of the intranet. It shall be better to clear everything in advance and leave with a happy note, than to land up in a dispute later.
