Co-operative society managing committee election query

Dear Sir, An Urgent Query: For the election of Managing Committee can 1 person be Proposer & Seconder for multiple Contestants for the election of Managing Committee Members?
If a person stands as Proposer or Seconder for Multiple Contestants is the Contestant eligible to contest for the election of Managing Committee or all such Contestants are disqualified & under what section of the Maharashtra Co-Operative Housing Society Act would they be disqualified?

Dear Ketan

firstly inform about your society bye laws

Thanks a lot for the reply Mr. Nadeem Qureshi.

When we checked in Co-Operative Bylaws it is no where stated about any limitations on any member to sign as Proposer or Seconder for number of contestants.

Also would like to know is there any time frame for an associate member to contest election from the date of his registration as Associate Member. As a new member cannot contest election for 2years from the date of registration as member of the Society. As stated in By-Laws it is states only the limitation for Primary Member to contest elections or voting which can be of 2years from the date of his registration with the Society. But there is no refrence given for the limitation/restrictions for the Associate Member to contest election or stand as Proposer or seconder for any Member Contesting for the election of the Managing committee from the date of his registration as Associate Member. Pls help as we have a situation where in the previous Managing Committee is playing games & trying to reject our people from contesting elections.

Thanks.

One member can be proposer or seconder for any number of members but the number should not be more than the number of members to be elected.  An Associate member is not eligible to be elected to the Managing Committee unless the byelaws of the Society specifically provide for it.

can a member not staying in the society stand for election

There is nothing in the Model Byelaws, the Act or the Rules, which prohibits a member not staying in his flat in the Society from contesting for a position in the Managing Committee.
