Co-opted member issues

Dear Sirs, Good Evening, I Mihir B Joglekar is resident of Co-operative Housing Society located at Kothrud, Pune, Maharashtra. My question is, on failing in meeting with the Quorum required for Managing Committee can Managing Committee can permit Co-opt Member option ? As far as recent changes in Co-operative Societies Act 1960 this option is removed. Please confirm. Further, kindly let us know what is the procedure for admission of New Committee Members as per By Laws of the CHS, as some of the members are willing to be part of the Managing Committee. Secondly, can that co-opt member sign on vouchers / Job Orders / Contract in place Chairman / Secretary / Treasurer ? Awaiting Response, Best Regards, Mihir Joglekar Place : Pune Date : 05-06-2017

There are three types of co-opted members of the Managing Committee according to the Maharashtra Model Byelaws. They are (1) 2 expert members, (2) 2 functional members and (3) a member of the Society co-opted in a mid-term vacancy or a vacancy due to non-availability of sufficient elected members in the Committee. The first two types of Managing Committee members have no voting rights. The third type of co-opted member will have all the rights of a Managing Committee member. Does this answer your question?

Thank You for your reply. But recent changes in By Laws ( Dec 2016 ) says U/s. 73CB Co-opted Option not allowed. Please clarify this issue

Co-option of a member to the MC in a mid-term vacancy is not allowed. In case of a mid-term vacancy the newly constituted election authority has to be informed.

It appears that Muhammad-bin-Tuglak has taken over Maharashtra Government. Even in normal circumstances it is difficult to get voluntary members to serve on the MC. Intimating the Election Authority is like dropping a stone in a well full of water. Societies will become leaderless with such laws.
