Company not paying F&F

Hello experts. Please help me. I worked in a BPO for almost 1 year. Everything was good then suddenly due to some charge backs from US customers company suffered some loss. After that it started paying salary very late. Some times in pieces like 25% 25% four time. I left the organisation and I was promised that my remaining 50% salary of Aug i will get by Sept. But I never get that. I sent so many emails and they always reply as wait for some time we do not have any update. After 1 month they included that salary portion in my F&F amount and told me that I will get it in 1 month. I waited for 1 more month and whenever I call the HR she says to wait we do not have any update. After some days they send me a cheque collection date of 1 month later date. I waited for that day but when it was about to come they sent me one more email saying date has been postponed and we will let you know about the new date next month. It's been 5 months company is ignoring and just giving me dates. I have also heard that United states our company is sued. I m tensed how would I get my money. Please tell me. Any email or phone to organisation gives only one response that is wait for some days we don't have any update

1) Its not known whether PF a/c is opened and whether the PF deducted has been remitted into your account with the concerned PF Commissioner.

 

2)  If you have the PF number, and the contractor has deducted the contribution from your salary as evident from your bank a/c or any other documents, you may make an application to the PF Commissioner mentioning the facts.

 

3) The salary and other dues, you have to take up with the US company as well as the Inspector or BPO Union operating in your company. 

 

4) If your post falls within the meaning of Workman as per ID Act or Employee as per the local SEAct, then issue notice to the BPO by taking advice of local labor law expert.
