US STATE ADVISORY TO NRIS MARRIED TO GIRLS IN INDIA

The United States Department of State has published the following travel warning:

A number of US men who have come to India to marry Indian nationals have been arrested and charged with crimes related to dowry extraction. Many of the charges stem from the US citizen’s inability to provide an immigrant visa for his prospective spouse to travel immediately to the United States.

The courts sometimes order the US citizen to pay large sums of money to his spouse in exchange for the dismissal of charges. The courts normally confiscate the American’s passport, and he must remain in India until the case has been settled.

It is stated in Travel Advisory by US, since the police may arrest anyone who is accused of committing a crime (even if the allegation is frivolous in nature), the Indian criminal justice system is often used to escalate personal disagreements into criminal charges. This practice has been increasingly exploited by dissatisfied business partners, contractors, estranged spouses, or other persons with whom the US citizen has a disagreement, occasionally resulting in the jailing of US citizens pending resolution of their disputes. At the very least, such circumstances can delay the US citizen's timely departure from India, and may result in an unintended long-term stay in the country. Corruption in India, especially at local levels, is a concern, as evidenced by Transparency International’s Corruption Perception Index of 3.5, ranking India in 72nd place of the world’s countries.

In a well publicized case, Dr. Balamurali Ambati, who earned his MD at age 17, and his family were detained in India for over three years in a suit related to alleged dowry demands by the family for his brother's wife Archana, which delayed Dr. Ambati's entry to the ophthalmology program for two years, leaving him to begin his residency in 1998. All charges against him were dismissed in October 1996 and all his family members were acquitted in June 1999. During the course of the trial the Ambatis produced a tape in which the father of Archana demanded US $500,000 to drop all the charges although the details of this particular case are still debated in India.

The Travel Warning issued by US state Department,
to US citizens of Indian Origin and similar Advisory
issued by Government of Canada regarding travel to
India to marry Indian Girls SPEAK VOLUMES about the
Extortion Rackets operating in India with collusion
of law enforcing machinery.

The said Warnings and Advisories suggest and confirm as under:
(1) That this problem is not on MINUSCULE SCALE
as made out by Indian Government.
(2) That the problem is REAL with NRI's and
Indian Diaspora, which has been investigated
in depth and found TRUE by agencies of the most
important governments of the world.
(3) These findings have not been contradicted by the
Government of India at any time so far is a proof
that such Rackets Exist in India.

Despite the presence of so many Indian-American
women's organisations, pro-women US laws, an
excellent legal system and strong police force,
to protect women; Indian women married to US based Indians are going to India to file criminal
cases under Indian Laws against their husbands and parents. over-ride the US Justice system,
and using Indian Corrupt, notorious and
in-efficient Judicial system.
The reason is very simple as under;
1. The IPC 498A of Indian Law is an
easy weapon to use for the criminal,
vindictive and abusive Indian wife/
daughter-in-law, with which the husband
and his entire parental family as well
as friends can be harassed, jailed, and
subjected to extortion and blackmail.
2. The US legal system and police force
investigates in details all the accusations,
and find the Truth.
If the woman is found to be lying,
she is being dealt with and punished.

Canadian Government has also issued following advisory:
Growing numbers of Canadian citizens have been caught up
in marital fraud and dowry law abuse in India.
Other cases involve misuse of Indians Dowry Prohibition Act. This law, which was enacted to protect women and makes demanding a dowry a crime, is sometimes used to blackmail men through false allegations of dowry extortion.
Individuals facing charges may be forced to remain in India until their cases have been settled or pay off their spouses in exchange for the dismissal of charges.
To avoid such problems, you are advised to register your marriage in India along with a joint declaration of gifts exchanged, as well as consider a prenuptial agreement.
