Court orders 'murdered' Deepika to go to place of her choice
KANPUR: Deepika alias Neha, whose in-laws and husband are behind the bar facing dowry death charges, was allowed to go anywhere according to her will by chief judicial magistrate of Ramabai Nagar on Tuesday.
After hearing the arguments of Deepika and the counsel for accused, the CJM passed the order and allowed her to go to the place of her choice but only after furnishing a personal bond of Rs 50,000 with an undertaking that whenever summoned, she would appear before the court.
Deepika was married to Sonu Awasthi in July 2010. She disappeared from her in-laws' house in October 2010. Her mother Sudha Shukla lodged a dowry death case against the in-laws, after identifying a woman's body which was found from Panki canal on October 27, 2010 as that of Deepika.
The police registered a case of dowry death against husband Sonu Awasthi, his father Dinesh Awasthi and brother Raman Awasthi and arrested them. Since then, all the three are behind the bars.
After some time, Neha was spotted by some persons in Barra locality and on confirmation she was found living with one Manish Trivedi of Baikunthpur in Bithore. Her in-laws informed the DIG and a fresh investigation took place and police nabbed Deepika from Barra on Sunday last. She was produced in the court on Monday.
Neha was produced before the court of chief judicial magistrate on Tuesday.
Manish Trivedi moved an application before the court and pleaded that he was her husband the girl should be released. Neha was major and her will must be considered by the court.
Counsel for accused objected and submitted that they were behind the bar under the charges of murder of girl and facing the trial. The sessions court had fixed February 24 for the prosecution evidence. If the girl would be released, then she would not turn up before the court. Therefore, she be sent to nari niketan till February 24.
