he can be prosecuted us 494 of IPC and 1st wife can file divorce petition or maintence petition us 125 crpc or sec 18 of ha&m act. 2nd marriage is null & void marriage 2nd wife has no right as like 1st wife

you used the word person.
first marriage is valid in the eyes of law, 2nd invalid.
spouse of 1st marriage can sue the other spouse.
for details read the ipc, 'offences relating to marriage' sec 493 to 498a.

But if both wifes have childern with same man, then what about there maintance..

children from 1st wife r legtimate & from 2nd marriage is void marriage the children r illegtimate. CHILDREN whether they r legtimate or illegtimate all r entitled for maintance from their father.
