Have they told you what it is regarding? If not, call up and ask them. They cannot arrest or search you without a warrant. Nor can they interrogate you if you don't want to cooperate. A vast majority of computer users have some mp3's, unlicensed software or p*rn on their computer, is that what is worrying you? Don't give the inspector any chance to harrass you by revealing how nervous you are. Mind you, I'm no legal expert I'm just guessing that you are assuming things based on one phone call. Go along and ask them what the problem is. They probably can't force you to go though.

To all honorable Ms.Uma,S Suchitra and Mr.Venu:It is very much easier to write in the column than denying a call from Police even in the dead of night as Indian Police has the authority to detain you even on suspicion without charge for up to 24 hours and if it want to harass you more, it can detain you on Friday, the next day may be weekly off day and the third day would be Sunday, so altogether a police can keep you for 72 hours without charge simply on suspicion and let you go free on Sunday Night or may be on Monday morning if your stars favor, could grease their palm or exert pressure of some well known goon/politician.

Kindly come to UP for once and get involved with police then you will learn lesson of your life.Apart from that if they want to detain you beyond this then simply they will not show your entry in their ROZNAMCHA or GD and if you happen to be smart and could approach some higher official/Chief Justice High Court/District Magistrate etc then they will shift you to some other police chowki (Check post) in a remote area and if further they can frame you in 25 A.Act,NDPS,107/116 CrPC/151 CrPC etc etc if required with all the professional witnesses.

I would request you that if you are not an lawyer and just a rustic simpleton law abiding ordinary citizen of India then kindly don't mess with a ordinary constable, and never to dream of challenging a ASI,SI,SSI,Inspector,SHO in India in particular and my state in particular otherwise you can escape the wrath of court by apologising but nobody could save you from these official as I mentioned and once a FIR is set up, even high Court would not come to your rescue.

As I always say that the truth is harsher than fiction.

Indian Police is supreme, Mr. O P Dhusia has explained the reality.

So in this regard, Follow the advice of a legal person.

CONSIDERING THE ABOVE POINTS OF MINE, IT IS NOT A CYBER CRIME BUT A SYSTEM OF POLICING.

AVOIDING CALL MAY INCREASE THE SUSPECT, SO PLEASE ATTEND IT WITH AN ADVOCATE.

Dear Friends, you must have noticed that whenever such issues crop up I have a harsh negative comments.The reason being that I have encountred those negative experience while facing the case of 364/302/201 IPC framed against my son and wife which took almost more than a decade and got conviction on fabricated evidences,corrupt prosecutor, false PW's,lethargic and incompetent defence and biased judge and there I learnt all the tricks of people involved and it is not just by sitting in the room.

There are many people who just pass a comment without knowing anything practically and wait for my comment and then try to negate my efforts by simply writing a few words as if they have been doing favors to them.Whereas for me once you have enrolled yourself and vowed to help the needy within your scope then why pretention for doing favor.

It is also ironic that none of advocate would have the guts to accompany you during call by police at the police station at least in my state UP and I am pretty sure this may be the norm in other states too.If someone suggests adverse then I again repeat he may not be talking about or staying in India.

Generally speaking the chill atmosphere one would not have experienced in the police station of India, the greatest pseudo democratic country in the world.

I have witnessed the cold blooded fake encounter in the dead of night and nothing happens thereafter but repetition of same story by the media, that two or three suspects were planning to rob.....challenged by police party(Because police is ever ready to fight the crime and criminals, even at 0200 or 0300 hrs)... opened fired first by suspects.. other accomplice could run away taking advantage of the darkness.... police retaliated in self defence and the suspect sustained injuries......died on the way to hospital and JAI HIND but there would not be any bullet found, fired by the suspect and no injury on the police personnels and very few cases of fake encounters are reported or police party convicted because every thing is stage managed.After 64 years of freedom we could see only two police party convicted, the one at Cannaught place in Delhi and the other at Punjab, whereas police fake encounters are the routine throughout India.

There are advocates who would sell themelves through LCI but still claim that they have been imparting a volunteer service (?) free of cost but would never suggest as to what their service had been.But silver lining is that a few are there to render their valuable advices but they are in minority and speak seldom.

Come to advocates and they would convert this Mahan Bharat into another Ram Rajya but with fees otherwise suffer the hades because they are not crusador but vu...rs ready to feed on the co..se.

Irony is that I still love this column because at least few people can bring solace to the hapless human beings.

Sau mai ninyanve be-iman fir bhi mera Bharat Mahan.

But still I love my nation more than anybody else because I am not a hypochrite.

well dear friend i would like to advise you that in our legislation of criminal procedure it is very clear under section 160 that a police officer can call any person in regard to investigation of any case,but he has to first give prior notice in written with signature , seal of police station, time and date to approach, name of the police officer who wants to call you, his designation etc.

otherwise police is supreme and bearing vast powers so try to go with an advocate alongwith you, he can not prevent you from coming with a lawyer,

...  But still I love my nation more than anybody else because I am not a hypochrite....

I am watching this thread carefully. Everyone is keen to extend help to him. Suchitra ji has done it will offering her assistance and it is a good option.

Now, I like to share my experience with police. Before about 4 years when I have found DRF and we were a few members together. As per our LINE OF ACTION – “Foundation for Social Justice and Constitutional Awareness for Trial of Public Service” we started our action. As a result there were all the unions of public servants of Secretariat of Maharashtra started meetings to find some stretagy against us but since we were not out of Law and so they started false complaints against us that we are creating fear and tension in their office.

There were calls coming on every alternate day from Police Stations on my mobile and I have attended every call and gone to meet them just immediate on a call. As we all know, they tried to show me every pulisiya tactics but after my entrance before them and a few talk of 5-10 minutes THEY SURRENDERED BEFORE ME. Telling you, they collected a bunch of complaints against me that I am misusing the organisation to create fear etc. and blackmailing to public servants and they started a case for sending me out of Mumbai declaring me a “TADIPAR”.  But NOTHING they succeeded. There were phones from the Home secretary to DGP, CP, DCP etc. to do something to close DRF and get me inside etc.  I have got copies of all such letters.  I was in mood to teach them lesson but I don’t want to waste my time & efforts for any other’s agenda so I only faced every situation and explained my side.

And now, I am enjoying the power. Our presence is not necessary but only watching to our letter-head they gets 104 degree bukhaar.  Gives TOP PRIORITY and sort out the matter same time with a request to us that if we want something more or how & what we want they will be pleased to fulfil accordingly.  None of them now even dare to see by a cross eye on us. And we never misuse this power and only do things of truth. It is the first rule in DRF that first we should be very clear & clean so that we may not come under fear of ANYONE AND SO WE DON’T MIND LIONS & TIGERS AND WE SIMPLY BELT THEIR NECK AND GIVES THEM SOME MILK AND BISCUITS.

In the case of Veny, Adv. Kushan has pointed the main thing.  Without knowing the reason none can suggest well. Both the sides of a coin needs to be seen first.

SO IF YOU ARE CLEAR & CLEAN JUST GO TO FACE HIM WITH WIDE CHEST AND HIGH NECK AND COOPERATE THEM WITH TO THE POINT ANSWERS TO THEIR QUIRES. AS A CITIZEN IT I OUR DUTY TOO.

No dear Arup, though I never boast of anything but what one can do if he has come across a vast experience in India and abroad inclusive and would want to share it with the common people, no matter if sounds to you as self glorifiaction, because sometimes grapes are sour and kindly do not indulge in name game, come straight to the subject and don't ape others always.

And I will keep on claiming to be more patriotic than others and that should not create envy to you.

I agree with you that advocates of substance come very occassioanally  on the forum to give their opinion, while one of the very best advocates, Mr. Prabhakar,  has sadly withdrawn his membership. He was the one who would spare  his  time to write detail replies in the family and few other forums, , explaining very patiently and in a simple language how to go about a particular case. With his deletion of account is gone easy reference to his contributions.
