My cousin sister maaried in Nov'11 and after 4-5 months they were separated with mutual agreement (notorised). As she has not completed 1 yr of marriage that time could not apply for Divorse. Now 1 yr is already completed, is it mandatory to apply for Divorse? Also note that she is getting married with another guy in next month. Pls advise.

the marriage would not be legal unless she seeks divorce from court of law that would take minimum six months by mutual consent. notorised divorce is not valid.

can't she parallelly apply for Divorce and get marriage ? Is it required to wait till finally she gets legally divorced ?
In earlier agreement it was stated that both are free to get Marriage.
what could be the consequences from earlier guy side if she marry without applying for divorce ?

She can not get remarried, till the divorce decree is passed and the time for appeal has elapsed.
